1. Custom Orders and Approved Specifications
Petroff PRO LLC, doing business as Hood2Home ("we" or "us"), makes custom decorative wood hood shells. The approved written quote and specifications identify the product, dimensions, insert model, wood, trim, finish and included services. An insert, ductwork, electrical work, installation and delivery are excluded unless expressly itemized.
The customer must review and approve these details before production. Changes to the insert model, dimensions, site conditions or selected options after approval require our written confirmation and may require additional payment and a revised schedule. Website images are illustrative; an approved material or design specification controls over an illustrative image.
2. Measurements and Insert Compatibility
The customer must provide accurate site measurements and the exact insert manufacturer, model and current manufacturer’s specification sheet, and have a qualified installer verify clearances, support, ducting, electrical requirements and site suitability before approving an insert-specific order. A nominal size, incomplete listing or link to a similar model is not adequate technical documentation. If documentation is incomplete or contradictory, we may request the actual insert or other reliable verification before agreeing to an insert-specific opening. We are not responsible for a mismatch caused by inaccurate customer information, an unapproved insert substitution or subsequent site changes.
For an insert-specific opening, before painting, staining, drilling, cutting, mounting or installing the shell, the customer or installer must inspect the shell and physically dry-fit the actual insert using its manufacturer’s instructions. Do not force the insert or alter the opening to resolve a suspected mismatch. Stop work and contact us first. If the actual insert is unavailable at handover, the check must still be completed before those works; pickup or delivery does not confirm an unperformed check.
INSERT INFORMATION DEADLINE AND STANDARD UNCUT-PANEL PROCEDURE: Paying a deposit reserves production under the agreed schedule; it does not reserve an indefinite period to select, purchase or document an insert. The customer must supply complete, reliable insert information, and the actual insert if reasonably required for verification, by the insert-information deadline stated in the accepted order. If no separate deadline is stated, the deadline is five business days after our written request, unless a later date has already been agreed in writing. Business days are Monday through Friday, excluding federal holidays. Insert selection, purchase delays, incorrect links and missing or inadequate documentation do not automatically extend this deadline or the agreed production schedule.
If the customer misses that deadline, we may, at our discretion and without further approval, continue production to the approved shell dimensions and supply a solid, removable bottom panel with no insert cutout. This is the standard procedure accepted with these Terms for an order lacking timely verified insert details. We will identify the missing information and applicable deadline in our written request and notify the customer if we proceed with the uncut panel. We are not required to hold a production slot open or repeatedly seek the missing information. This procedure applies only where the approved shell dimensions, available internal space and construction allow a technically suitable removable panel; unresolved essential shell specifications may require rescheduling. A deadline may not override a later date already agreed for providing insert information.
For an uncut-panel order under this procedure, the customer and their qualified installer are responsible for selecting a suitable insert within the approved shell’s available space and preparing its opening, mounting and support. Before any cut, the installer must verify the actual insert, its manufacturer’s documentation, cutout layout, clearances and support requirements. The installer must then complete the agreed cutout and physically check fit before final finishing and mounting. The general requirement not to alter a suspected incorrect opening does not prohibit this contractor cutout contemplated by this procedure. Do not install or operate the ventilation appliance against a closed panel or use the panel as insert support unless the manufacturer’s instructions and the approved construction permit it.
A correctly supplied uncut panel under this accepted procedure is not a missing insert opening or manufacturing defect. Later insert fitting, cutout work, resizing, rework and related contractor costs are not included unless separately agreed in writing. We are not responsible for incompatibility or damage caused by a later insert selection or third-party work. We remain responsible for any legally actionable failure of our product to match the approved specifications; these customer duties and this option do not excuse our manufacturing errors or remove mandatory legal rights. The customer’s failure to provide insert information on time does not by itself entitle the customer to a refund, free later cutout, free rework, extended payment deadline or postponement of the agreed collection arrangements. The order remains subject to the agreed payment and storage terms and any mandatory legal rights. This procedure does not retroactively change an existing order that did not include it; such an order requires an agreed change.
3. Order Confirmation
Production requires the agreed deposit and approval of the applicable shell specifications. For an insert-specific order, sufficient verified insert information is required before the affected work begins. Where the customer misses the insert-information deadline, the standard uncut removable bottom-panel procedure in Section 2 allows us to proceed without an insert cutout, where technically suitable, without seeking further approval.
The customer must provide required information by the dates agreed for the order. Customer-caused information delays may affect the production slot and completion estimate; rescheduling will be communicated in writing. We do not promise that a delayed order will retain an earlier completion date. Changes after production starts require our written confirmation and may affect price and timing.
4. Deposit and Payment
Unless the approved quote states otherwise, a 50% deposit is required before production. The remaining balance must be paid by the due date or within the payment period expressly stated in the accepted quote, contract or invoice forming part of the agreed order. If no separate due date or payment period is agreed, the remaining balance is due at pickup or delivery, before loading or unloading and before the product is released.
FULL PAYMENT IS REQUIRED BEFORE HANDOVER. For pickup, we must confirm receipt of the full balance before the product is loaded or released. For delivery, we must confirm receipt before unloading or transferring possession. We verify payment through our own payment account or payment provider. A customer’s screenshot, a pending or scheduled transfer, or a promise to pay later is not sufficient confirmation. A different payment or release arrangement requires our prior written agreement.
The customer must arrange an accepted payment method in advance and have the necessary funds available at the appointment. If payment cannot be confirmed, handover will be postponed until payment is confirmed, subject to any different arrangement agreed in writing. Any additional delivery or other charge must be separately agreed in advance or otherwise legally recoverable; a failed handover does not authorize an undisclosed automatic fee.
A customer-requested postponement of pickup, delivery or installation does not automatically extend a separately agreed payment deadline. Any extension must be confirmed by us in writing. A later invoice cannot unilaterally accelerate a payment deadline already agreed for the order.
We may withhold release of the product while an undisputed payment is overdue. A storage charge under Section 13 is separate from the product balance and does not replace or extend the agreed payment deadline. Any cancellation and retained payments are subject to Sections 5, 6 and 18 and applicable law. This section does not waive a lawful right to dispute an amount or withhold payment where applicable law permits it.
5. Deposit Applied to a Custom Order
The deposit is applied to the custom order and authorizes the agreed production preparation, material commitments and work. It is not an unrestricted right to cancel. If cancellation is requested, any amount retained and any refund are determined under Section 18; paying a deposit does not authorize a penalty or forfeiture prohibited by law.
6. Custom Products and Change-of-Mind Returns
A product that conforms to the approved specifications is not eligible for a change-of-mind return or exchange, including because of a later style preference, changed project plans, customer measurement error or an unapproved insert change. Cancellation is addressed in Section 18. These restrictions do not remove remedies for a valid defect or nonconformity claim or any right that cannot lawfully be excluded.
7. Production Time
Production times are estimates and may vary depending on workload, material availability, and project complexity.
Petroff PRO LLC is not responsible for delays caused by circumstances beyond its control.
8. Pickup and Delivery Arrangements
Pickup or delivery must be arranged in advance. The customer must attend or designate a representative who can inspect and receive the product on the customer’s behalf. Please tell us in advance if the representative cannot complete an inspection. The customer must provide safe access and suitable personnel, vehicle and equipment for customer-managed handling or transport. Unattended delivery requires a separate written arrangement.
9. Inspection, Acceptance and Reporting a Problem
At pickup or delivery, we will provide a reasonable opportunity to inspect the shell before handover is completed. Check visible condition, ordered options, accessible dimensions, trim and finish against the approved order. Record any visible damage, missing item or discrepancy on the handover record and tell us immediately. Photograph the product and any concern before moving, finishing or installing it. Do not sign that a check was completed if it was not.
A handover record documents what was reasonably observable and any exceptions; it is not a waiver of a hidden defect or other protected right. If an issue could not reasonably be discovered at handover, notify us within a reasonable time after discovering it or when it should have been discovered. We do not impose an automatic same-day cutoff on hidden-defect claims.
For a claim, email petroff1pro@gmail.com with the order reference, a description, photos and, where relevant, measurements and the insert model/specification sheet. If email is unavailable, call (561) 475-9708 promptly and follow up in writing when possible. Keep the shell, affected parts and relevant packaging available for reasonable inspection. Stop work that could worsen the issue; arrange a reasonable opportunity for us to inspect and respond before commissioning corrective work, except where immediate action is reasonably necessary for safety or to prevent further damage. This process does not extend any applicable legal deadline.
10. Installation and Contractor Work
Installation is not included unless expressly agreed in writing. The customer selects and manages any independent installer, painter, finisher or other contractor. They must follow the approved shell specifications, insert manufacturer’s instructions and applicable building, fire and electrical requirements.
We are not responsible for damage or incompatibility caused by third-party handling, inadequate support, improper fasteners, incorrect clearances, ducting or electrical work, forced insert fitting, or other improper installation. The exclusion applies to the extent the issue is caused by that work, and does not excuse a pre-existing defect for which we are legally responsible. Work expressly undertaken by us remains our responsibility under the agreement and applicable law.
11. Wood, Finish and Care
The finish included in the purchase is only the finish identified in the approved quote. Paint-ready, unfinished, professionally painted and stained products are different options. A customer-applied finish, preparation, color choice or coating system is the customer’s and their finisher’s responsibility.
Natural wood can vary in grain, color and texture, and screens and lighting affect perceived color. Reasonable natural variation within the approved material or sample is not by itself a defect; this does not excuse a wrong material or an expressly agreed finish that we failed to supply.
After receipt, protect the shell from water, excessive humidity, unsuitable heat, direct weather, impact and inappropriate storage. We are not responsible for damage caused by improper storage, environmental exposure, unsuitable coatings or third-party finishing. This does not exclude a defect in finishing expressly supplied by us.
12. Limitations of Liability and Preserved Rights
TO THE EXTENT PERMITTED BY APPLICABLE LAW, WE EXCLUDE LIABILITY FOR INDIRECT, INCIDENTAL OR CONSEQUENTIAL ECONOMIC LOSSES, INCLUDING LOST PROFITS, PROJECT DELAYS AND CONTRACTOR RESCHEDULING. TO THAT SAME EXTENT, OUR AGGREGATE LIABILITY ARISING FROM THE AFFECTED PRODUCT IS LIMITED TO ITS PURCHASE PRICE.
THESE LIMITS DO NOT APPLY TO FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE, PERSONAL INJURY OR OTHER LIABILITY THAT CANNOT LAWFULLY BE LIMITED. THEY DO NOT OVERRIDE A REMEDY THAT MUST REMAIN AVAILABLE UNDER APPLICABLE LAW OR AN APPLICABLE WRITTEN WARRANTY. Some laws do not allow particular exclusions or limitations, so those limits may not apply to you.
Acceptance, payment, finishing or installation does not automatically eliminate a valid claim for a pre-existing hidden defect or our failure to supply the agreed product. These Terms do not create a separate written product warranty or disclaim implied warranties. Any separate applicable warranty and rights required by law remain in effect.
13. Delayed Collection and Storage
Unless a different arrangement is agreed in writing, the customer must collect the completed product or arrange delivery within seven calendar days after our written ready-for-pickup or ready-for-delivery notice. The free storage period begins on the day after that notice, but no earlier than the completion date or window agreed for the order. Our notice will identify the last free storage date and the date any storage charge begins. Early completion does not shorten the agreed schedule without the customer’s agreement.
When disclosed and agreed in writing before the order is placed, storage after that seven-day period is charged at $5 per calendar day per hood shell, reflecting space and handling costs, to the extent commercially reasonable and permitted by law. The charge is for storage, not a penalty, and will be itemized. It stops when the product is physically handed over to the customer or designated representative, or when the delay no longer qualifies for a charge under this section.
No charge applies for any period attributable to our inability to offer reasonable pickup access or perform our agreed delivery, an unresolved defect or nonconformity for which we are responsible that prevents proper handover, or an extension agreed in writing. If the customer promptly requests delivery within the free period and accepts our earliest reasonably available delivery appointment, no storage fee is charged while waiting for that appointment. Any different storage arrangement must be confirmed in writing.
This policy applies only when disclosed and accepted as part of the order. Existing orders are not charged retroactively; a new storage arrangement for an existing order requires written agreement before charges begin. The remaining product balance must be paid by the deadline agreed for the order under Section 4, or, if no separate deadline is agreed, before or at pickup or delivery. Storage or a customer-requested delay does not extend a separately agreed payment deadline. Storage charges do not authorize automatic forfeiture, disposal or resale of the customer’s product. Any further remedy must comply with applicable law.
14. Agreement and Order Records
These Terms form part of an order when made available to the customer before the agreement and accepted with the quote, order confirmation or other recorded assent. Customers should retain their approved specifications, quote and accepted version of these Terms. The written, specifically agreed order details control if they conflict with a general provision here.
A later website revision does not retroactively change an existing order without agreement. A pickup or delivery signature records receipt, inspection and noted exceptions; it does not introduce undisclosed contract terms or waive rights that cannot be waived. We may record order communications and product condition photographs to document performance and resolve questions.
15. Handover and Responsibility After Receipt
Unless otherwise agreed in writing, delivery is to one safe, accessible ground-level location, such as a driveway, garage or front entrance. Upstairs transport, inside placement, installation and packaging removal are not included. The customer must arrange any further handling.
For a conforming product, responsibility for safekeeping and the risk of subsequent accidental loss or damage pass to the customer when the customer or designated representative physically receives it at pickup or the agreed delivery location, subject to applicable law. Our agreed handling before that point remains our responsibility. Unattended delivery and any different risk arrangements must be agreed separately in writing.
After handover, we are not responsible for damage caused by the customer or third parties during loading or transport they undertake, moving, storage, finishing, alteration or installation. We do not assume responsibility for later project changes or customer-selected equipment. This allocation does not eliminate a valid claim for a defect or damage already present at handover or damage caused by us.
16. Design Variations and Tolerances
Custom dimensions may change the proportions shown in illustrative photographs. Any material design detail or dimensional tolerance must be stated in the approved order to govern that order. A tolerance is not permission to supply the wrong design, disregard a specifically agreed critical dimension or prevent fit of the exact insert for which compatibility was expressly agreed. There is no blanket website tolerance overriding the approved specifications.
17. Payment Questions and Disputes
Please contact us promptly with a payment or product concern so we can review the order records and attempt to resolve it. We may provide the approved specifications, communications, handover record and condition photographs to a payment provider or other appropriate decision maker.
Nothing here prohibits a lawful chargeback, billing-error notice, complaint or other legal remedy, or requires the customer to miss a statutory or card-provider deadline. We do not impose an automatic chargeback penalty or administrative fee. Any recovery of costs or legal fees requires a valid contractual and legal basis.
18. Cancellation Requests and Amounts Retained
Custom production involves commitments that may not be reversible. Request a cancellation promptly in writing. We will confirm whether work can be stopped and identify the order’s production status. A cancellation request does not automatically cancel the order or release amounts lawfully owed.
If the order is cancelled or terminated, any retained payment must reflect amounts we are legally entitled to recover, such as reasonably established losses from committed custom materials, completed work and other recoverable costs or damages. We will account for avoided costs, recoveries and credits required by law, avoid double recovery, and provide a written calculation of the amount retained and any refund due. A deposit is not automatically forfeited in full merely because production has begun.
Any separately agreed cancellation charge must comply with applicable law and must not be an unlawful penalty. This policy does not limit a legally required refund or remedy arising from our breach. The change-of-mind restriction in Section 6 remains applicable to conforming custom products.
19. Finishing, Alterations and Avoidable Costs
BEFORE ANY PAINTING, STAINING, DRILLING, CUTTING, RESIZING, REMOVAL OR REPLACEMENT OF PARTS, MOUNTING OR INSTALLATION: inspect the shell, check the approved dimensions and physically dry-fit the actual insert. If anything appears wrong, stop and contact us before proceeding. For a standard uncut removable bottom panel under Section 2, the planned installer cutout is permitted only under the verification and fitting sequence in Section 2. This exception does not authorize cutting to correct a suspected manufacturing error without first contacting us.
Customer or third-party alterations are performed at the customer’s risk. We do not cover a mismatch, loss of strength, cosmetic problem, damage or other failure to the extent it is caused by those alterations, improper installation, an insert change or failure to follow the required checks and instructions. Alteration does not make a conforming custom product eligible for a change-of-mind return.
To the extent permitted by law, we do not pay additional finishing, removal, reinstallation or contractor costs that reasonably could have been avoided by checking fit and condition and stopping work when a problem became apparent. We do not authorize a customer or contractor to commission work at our expense without our written agreement, except where applicable law provides otherwise. Alteration alone does not void an unrelated, valid claim for a pre-existing defect.
